Terms of Service

1. Acceptance of Terms

By accessing and using Keepace, you (the "End-User") accept and agree to be bound by these Terms of Service. This agreement is between you and Keepace only, and not with Apple, Inc. ("Apple"). Keepace is solely responsible for the Application and the content thereof.

2. Scope of License

The license granted to you for Keepace is a non-transferable license to use the Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the App Store Terms of Service, except that such Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

3. Maintenance and Support

Keepace is solely responsible for providing any maintenance and support services with respect to the Application. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

4. Warranty

Keepace is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application to you; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.

5. Product Claims

You acknowledge that Keepace, not Apple, is responsible for addressing any claims of the end-user or any third party relating to the Application or the end-user's possession and/or use of that Application, including: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

6. Intellectual Property Rights

You acknowledge that, in the event of any third party claim that the Application or your possession and use of that Application infringes that third party's intellectual property rights, Keepace, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

7. Subscription and Payments

Keepace offers "Keepace Premium" as a subscription service. Payments are processed through the Apple App Store. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24-hours prior to the end of the current period.

8. AI Content Disclaimer

Keepace uses Artificial Intelligence (Gemini AI) to provide theological and historical context for scriptures. While we strive for accuracy and reverence, AI-generated content may occasionally contain errors or interpretations that do not align with specific personal or denominational beliefs. Users are encouraged to use the app as a study aid alongside traditional scholarly and religious resources.

9. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

10. Third Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.

12. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of your jurisdiction and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
